CÓMO PASAR DE LA IMPUNIDAD AL CONTROL EXCESIVO
A través del artículo Primero Once del Real Decreto 1070/2017, de 29 de diciembre y del Proyecto de Orden por la que se aprueba el modelo 179 si usted es propietario de una vivienda que alquila por temporadas (en Baleares alguno hay….) habrá visto que la Agencia tributaria lo tiene en el punto de mira.
Es cierto que no es la primera vez que Hacienda tarda en actuar (juego online, venta de productos por internet, etc.) pero cuando llega se pasa de frenada e intenta regular todo y más allá.
La nueva ocurrencia es que a partir de 2018 las plataformas (airbnb, booking, etc.) que gestionan el alquiler vacacional deben presentar ante la Agencia tributaria un modelo tributario informativo de los alquileres en los que hayan intermediado (tanto si han cobrado por ello como si no).
En el proyecto de ley del modelo informativo se deberá informar de los siguientes datos:
- Details of the property offered for rent (with cadastral reference), as well as the details of its owner.
- The details of the tenants, the number of days they have used the dwelling and the amount received by the owner of the dwelling.
Therefore, with a view to the 2018 personal income tax return (to be filed in 2019), do not leave any rent undeclared in your return, as it will now be even easier for the Tax Agency to detect it, and the minimum penalty may be 50% of the tax not paid.
